Brasil adere à Convenção de Haia sobre Provas

Em 9 de abril do presente ano, o Brasil se tornou o 58º membro da Convenção de Haia sobre Provas: um acordo de cooperação internacional que tem por objetivo facilitar a transmissão e a execução de cartas rogatórias, tornando mais eficiente a cooperação judiciária internacional em matéria civil e comercial.

A adesão ainda que tardia do País – a Convenção é datada de 18 de Março de 1970 – é tida como um avanço vez que, ao afastar a via diplomática, confere maior eficiência e eficácia aos processos que dependem de obtenção de provas em outros países, contribuindo para a celeridade da marcha processual.

O texto da Convenção simplifica o processo para produção de provas internacionais em processos judiciais na área civil e comercial, dispensando a intervenção do Ministério das Relações Exteriores. Ele permite que o juiz expeça a carta rogatória diretamente para o Departamento de Recuperação de Ativos e Cooperação Jurídica Internacional da Secretaria Nacional de Justiça – DRCI/SNJ, responsável por centralizar os pedidos de auxílio jurídico. Permite ainda a oitiva de testemunhas por agente consular ou diplomático desde que não haja coação para que esta preste depoimento.

O texto prevê ainda reciprocidade entre os signatários, de modo que os pedidos dos 57 países estrangeiros serão atendidos pelo Brasil com maior eficiência.

Dentre as outras justificativas utilizadas para a adesão do País as principais são o crescimento das comunidades brasileiras no exterior, bem como a recusa de muitos Estados em negociar acordos bilaterais sobre o assunto por preferirem a utilização deste instrumento multilateral.

Vale ressaltar que a adesão não impede a celebração de acordos bilaterais entre países interessados regulando os procedimentos para obtenção de provas, desde que estes sejam mais benéficos às partes.

Segundo informações divulgadas pelo Ministério da Justiça, a adesão à Convenção ocorreu durante a Reunião Anual do Conselho de Assuntos Gerais de Haia, realizada no início de abril na cidade de Haia, nos Países Baixos, e advém de um esforço conjunto dos Ministérios da Justiça e das Relações Exteriores, que trabalharam juntos promovendo o estudo do texto, tradução e envio para aprovação pelo Congresso Nacional.

O texto da Convenção de Haia sobre Provas já havia sido aprovado pelo Congresso Nacional por meio do Decreto Legislativo 137/2013, e seguirá para sanção da presidente Dilma Rousseff.

[:fr]Le 9 avril dernier, le Brésil est devenu le 58ème membre de la Convention de la Haye sur l’obtention des preuves à l’étranger en matière civile ou commerciale: un accord de coopération internationale dont l’objectif est de faciliter la transmission et l’exécution de commissions rogatoires afin de développer l’efficacité de la coopération judiciaire internationale en matière civile et commerciale.

L’adhésion si elle est tardive – la Convention date du 18 Mars 1970 – représente un réel progrès. Elle écarte la voie diplomatique et confère plus d’efficience et d’efficacité aux procès qui dépendent de l’obtention de preuves dans un autres pays contribuant ainsi à la célérité des procès en cours.

Le texte de la Convention simplifie la procédure de la production de preuves internationales dans les domaines civil et commercial en excluant l’intervention du Ministère des Affaires Étrangères. Il permet que le juge expédie la commission rogatoire directement au Département de Récupération d’Actifs et Coopération Juridique Internationale du Secrétaire National de Justice – DRCI/SNJ (Departamento de Recuperação de Ativos e Cooperação Jurídica Internacional da Secretaria Nacional de Justiça), organe responsable de la centralisation des demandes d’assistance juridique. Il permet encore l’écoute des témoins réalisée par un agent consulaire ou diplomatique dès lors que le témoignage est volontaire.

Le texte prévoit également un principe de réciprocité entre les signataires impliquant que les demandes des 57 pays étrangers soient prises en charge par le Brésil avec plus d’efficacité.

La croissance des communautés brésiliennes à l’étranger et le refus de plusieurs Etats dans la négociation d’accords bilatéraux sur ce sujet préférant se soumettre aux dispositions de la Convention internationale sont les principales raisons justifiant l’adhésion du Brésil.

Il convient de souligner néanmoins que l’adhésion à la Convention n’empêche pas la signature d’accords bilatéraux pour la règlementation des procédures d’obtention de preuves entre des pays intéressés, à condition que ceux-ci soient plus avantageux pour les parties.

Selon les informations transmises par le Ministère de la Justice, l’adhésion à la Convention a été décidée pendant la Réunion Annuelle du Conseil sur les Affaires Générales de la Haye, qui a eu lieu début avril dans la ville de la Haye, aux Pays Bas. Elle résulte des efforts collectifs des Ministères de la Justice et des Affaires Etrangères qui ont collaboré pour la promotion de l’étude, traduction et transmission du texte au Congrès pour son approbation.

Le texte de la Convention de la Haye sur l’obtention des preuves a été adopté par le Congrès par le Décret Législatif n° 137/2013 et dépend désormais de l’approbation de la Présidente Dilma Rousseff.[:en]On 9 April 2014, Brazil became the 58th member of the Hague Evidence Convention: an agreement for international cooperation which aims at facilitating the transmission and performance of rogatory letters so as to obtain more efficient international judicial cooperation in civil and commercial matters.

Although the accession of the country is considered as late – the Convention is dated 18 March 1970 – it is also considered a breakthrough given that in dismissing the diplomatic route it provides greater efficiency and effectiveness to the proceedings that depend on obtaining evidence in other countries — helping to expedite the procedural motion.

The text of the Convention simplifies the process for the production of international evidence in court proceedings in the areas of civil and commercial law, dismissing the intervention of the Ministry of Foreign Affairs. This allows the judge to dispatches rogatory letters directly to the Department of Assets Recovery and International Legal Cooperation of the National Secretariat of Justice of Brazil – DRCI / SNJ, responsible for centralising requests for legal aid. It also allows the hearing of witnesses by consular or diplomatic agents, provided that there is no duress to testify.

The text also provides reciprocity between the signatories enabling the requests of 57 foreign countries to be attended by Brazil with greater efficiency.

Among the other justifications for the accession of the country, the main reasons are the growth of Brazilian communities abroad as well as the refusal of many States to negotiate bilateral agreements on the subject as they prefer the use of this multilateral instrument.

It is noteworthy that the accession does not prevent the conclusion of bilateral agreements between countries concerned regulating the procedures for the taking of evidence provided that such case is more beneficial to the parties.

According to information disclosed by the Ministry of Justice, the accession to the Convention took place during the Annual Meeting of the General Affairs Council in the Hague — held in early April in the city of the Hague in the Netherlands — and comes from a joint effort of the Ministries of Justice and of Foreign Affairs which have worked together promoting the study of the text, its translation and sending for the Congress’ approval.

The text of the Hague Evidence Convention had already been approved by the Brazilian Congress through the Legislative Decree 137/2013 and will carry on for the sanction of President Dilma Rousseff.[:]
