Judicial and Extrajudicial Auctions

• Assistance to national and international clients in the selection of movable and immovable property available for auction in judicial and extrajudicial auctions;
• Analysis of notices, procedures and processes, as well as analysis of real estate documentation, liens and encumbrances, aiming at legal security, risk reduction and feasibility study for the auction of assets in judicial and extrajudicial auctions;
• Checks regarding the occupation of real estate;
• Assistance to national and international clients in all previous and subsequent phases of auctioning assets in judicial and extrajudicial auctions;
• Assistance to national and international clients in all procedures arising from the auctioning of assets in auctions, notably vacancy of auctioned properties, impositions on possession and collection of debts related to the occupation of third parties;
• Legal assistance in formalizing the sale (contract, certificates, deed and notary registry), or lease (contract, consultancy) of movable and immovable property auctioned in judicial and extrajudicial auctions;
• Tax consultancy related to the area of ​​judicial and extrajudicial auctions with the objective of reducing the taxes eventually due with the auction (ITBI, IPTU, ICMS, etc.) and to the tax planning related to the incorporation of the asset into the bidder’s equity.
