FEDERATIVE PROGRAMME TO COMBAT THE NEW CORONAVIRUS: A Supplementary Law was published on 28 May 2020 creating the Federative Programme to Combat the new Coronavirus (exclusively for 2020) which foresees the transfer of BRL 60 billion by the Federal Government to States, Federal District and Municipalities, to be used in the fight against the Pandemic. The Supplementary Law also determines the suspension of debts of the States, Federal District and Municipalities with the Federal Government. Supplementary Law No. 173 of 27 May 2020.
EMERGENCY PROGRAMME TO MAINTAIN EMPLOYMENT AND INCOME: Provisional Measure No. 936/2020 was extended today (28), for 60 days. It created the Emergency Programme for the Maintenance of Employment and Income and includes complementary labour measures for the combating of public calamity. The Provisional Measure authorises the reduction of wages and working hours of employees by 25%, 50% and 70%, with the Federal Government compensating part of the wage loss. COVID-19 COMBATING MEASURES: On 26 May 2020, a Provisional Measure was published opening an extraordinary credit of BRL 15 billion to supplement the Federal Government’s financial expenses, to be assigned to the National Support Programme for Microenterprises and Small Businesses. INCLUSION OF MICROENTERPRISES IN THE “LEGAL TAXPAYER” LAW RULES: on 27 May 2020, the House of Representatives unanimously approved a Supplementary Bill that allows the negotiation of micro and small companies’ debts with the Federal Government, under the terms of the “Legal Taxpayer” Law (Law No. 13,988/20). DEDUCTION OF DONATED AMOUNTS IN FAVOUR OF NEW CORONAVIRUS COMBAT FROM THE INCOME TAX CALCULATION BASE: On 26 May 2020, a Bill was presented in the Federal Senate foreseeing an exceptional hypothesis of deduction – from the Income Tax Calculation Base – of donated amounts in favour of entities and actions to combat the new coronavirus. USE OF PRIVATE ICU BEDS BY PUBLIC HEALTHCARE SYSTEM’s PATIENTS: On 26 May 2020, the Senate unanimously approved the Bill authorising the use of unoccupied ICU beds in private hospitals by patients in the public healthcare system with COVID-19 suspicion or diagnosis. If approved without changes, all hospitals will be obliged to inform daily the availability of beds in their infirmaries, apartments, and ICU. The matter goes to the House of Representatives. RIO DE JANEIRO LEGISLATIVE ASSEMBLY EXTENDS ADDITIONAL PENSION TO CIVIL SERVANTS KILLED BY COVID-19: on 26 May 2020, the Rio de Janeiro Legislative Assembly (ALERJ) approved a Bill that extends the additional of 100% to pensions for death to state employees of Public Security, Health and Social Assistance due to Covid-19, as long as the disease was contracted during the practice of office.
