(Français) Brésil : augmentation du montant minimal d’investissement nécessaire à l’obtention du visa permanent d’investisseur.

La Résolution Normative nº118 du 21 Octobre 2015 a modifié substantiellement les critères de concession des visas permanents à des investisseurs étrangers au Brésil. Effectivement, le Conseil National de l’Immigration a majoré considérablement le montant de l’investissement nécessaire à ce type de visa.

Auparavant, l’investissement en devises étrangères apporté par le candidat aurait dû être égal ou supérieur à R$ 150,000.00 (cent-cinquante-mille Reais). Cependant, en cas d’investissement inférieur à ce seuil il était encore possible de demander un tel visa, dès lors que certains critères auraient été respectés[1].

Désormais, le montant minimal de l’investissement nécessaire à l’obtention d’un visa investisseur est porté à R$500.000,00 (cinq-cent-mille reais), et les dossiers de demande de visa doivent être toujours accompagné d’un « plan d’investissement ».

Suivant la même logique de la réglementation antérieure, il est encore possible de demander un tel visa en apportant un investissement inférieur à celui normalement demandé. Cependant, cet investissement ne saurait être inférieur à R$150.000,00 (cent-cinquante-mille Reais) et le Conseil Géneral d’Immigration (CGI) doit encore évaluer si le projet destinataire de l’investissement rempli, au moins, l’une des conditions suivantes :

  • avoir reçu, d’une entité publique, un investissement, un financement ou des ressources destinées à l’innovation
  • se trouver dans un parc téchnologique
  • se trouver dans une pépinière d’entreprises ou l’avoir été ou moment de sa création
  • avoir été finalistes d’un programme public d’appui aux startups
  • avoir bénéficié d’un programme brésilien d’accelération de startups.

Alternativement, la RN 118/2015 permet également la délivrance du visa d’investisseur lorsque la société, nouvellement créée ou déjà existante, puisse prouver:

  • l’originalité et la nouveauté du produit
  • l’ampleur de la capacité de pénétration du produit dans le marché
  • la pertinence quant à l’impact du produit et sa capacité potentielle de générer de la valeur

Il convient de préciser que la RN 118/2015 a abrogé expressément la Résolution Normative 84/2009 qui régulait la délivrance de cette catégorie de visas. En conséquence, il a également été abrogé la détermination selon laquelle les entrepreneurs issus d’un pays sud-américain auraient droit à une considération speciale.

The Normative Resolution No. 118, issued on October 21 2015, brought significant changes on the granting of permanent residency visa to foreign investors in Brazil.

Indeed, the National Board of Immigration has increased significantly the amount to be invested in Brazil by the foreign candidate applying to such a visa.

Previously, the investments in foreign currency should be equal to or greater than R$150,000.00 (one hundred and fifty thousand Reais). Nevertheless, the National Immigration Council could grant such a visa in exceptional cases even if the amount stood below the aforementioned value, if a few conditions were respected¹.

Currently, accordingly to the new Normative Resolution 118/2015, the minimum amount for the granting of the investor’s visa was raised to R$ 500.00,00 (five hundred thousand Reais), and the visa request shall always contain an “investment plan”.

As the previous regulation, the new one also allows the visa application with invested capital inferior to the required amount. However, the investment shall be higher than R$150.00,00 (one hundred and fifty thousand Reais) and the General Immigration Counsel shall evaluate if the business receiving said investment satisfies at least one of the following requirements:

  • to have received investments, funding or resources directed to supporting the innovation from a governmental institution
  • to be located in a technological park
  • to be an incubated business or have been previously incubated
  • to have being a finalist on a governmental program of startup stimulation
  • to have benefited from a Brazilian startup acceleration program.

Alternatively, the NR 118/2015 also allows the possibility of granting a visa to a foreign investor when the company, whether newly formed or pre-existing can prove:

  • the originality of the product (novelty)
  • the product’s capacity of penetrating the market
  • the product’s relevance and its potential on creating value

Finally, it’s worth to mention that the RN 118/2015 expressly abrogated the former Normative Resolution 84/2009 regulating this kind of visa. Thus, it also abrogated the article giving nationals of South American countries a special consideration on their visa requests.
