MEDIDAS DE ENFRENTAMENTO AO COVID-19: o Plenário do Senado aprovou o PL que amplia o número de beneficiários com direito ao auxílio emergencial de R$ 600, pago aos trabalhadores de baixa renda prejudicados pela Pandemia. O projeto substitutivo ao denominado “coronavoucher” estende o benefício para outras categorias de trabalhadores informais e autônomos, bem como assegura que o benefício contemple apenas os trabalhadores que estejam com CPF regularizado. O PL aguarda sanção presidencial. PL nº 873/2020.

VOTO DE QUALIDADE NO CARF: o Instituto Nacional de Defesa em Processo Administrativo (Indepead) propôs uma Ação Civil Pública com objetivo de extinguir o artigo 28 da Lei nº 13.988, de 14/04/2020, que determina o fim do voto de qualidade no CARF. Sob a argumentação de afronta à Constituição Federal e ao Código Tributário Nacional, o Instituto alega usurpação da competência e que o cenário econômico atual não comporta os efeitos fiscais de tal medida. LINHA DE CRÉDITO PARA MICRO E PEQUENAS EMPRESAS:  a Câmara dos Deputados aprovou o PL do Senado, que concede linha de crédito especial para micro e pequenas empresas pedirem empréstimos de valor correspondente a até 30% de sua receita bruta obtida no ano de 2019. O prazo de pagamento será de 36 meses, com carência de oito meses para começar a pagar as parcelas e durante o período de carência, o empréstimo será corrigido apenas pela taxa Selic vigente. A proposta aprovada retornará ao Senado devido às mudanças. PL nº 1282/2020.

SUSPENSÃO DO PAGAMENTO DE TRIBUTOS: o Tribunal de Justiça de São Paulo concedeu liminar a empresa para suspender por 60 dias o pagamento de IPTU e ISS. No processo, o pedido da autora foi negado em 1ª instância. Após a interposição de Agravo de Instrumento, a liminar foi concedida pelo Tribunal. AGI nº 2067266-72.2020.8.26.0000.

MEDIDAS DE ENFRENTAMENTO AO COVID-19  NO DISTRITO FEDERAL/DF: a Câmara Legislativa do Distrito Federal aprovou o PL nº 1.136/2020, que obriga o uso e o fornecimento de máscaras de proteção em estabelecimentos públicos, industrias, comerciais, bancários, rodoviários, metroviários e de transporte de passageiros, como medida de enfrentamento à disseminação do novo coronavírus. A proposta segue para sanção do governador Ibaneis Rocha. PL nº 1.136/2020.

INCIDÊNCIA DA MULTA ISOLADA NA COMPENSAÇÃO TRIBUTÁRIA: o Ministro Gilmar Mendes, do STF, pediu vista do processo que discute a aplicação da multa de 50% sobre os valores de restituição ou compensação tributária considerados indevidos pela Receita Federal (“multa isolada”). No mesmo sentido, retirou-se da pauta do plenário virtual a ADI nº 4.905, que trata do tema. RE nº 796939/RS.

 


 

COVID-19 COMBATING MEASURES:  The Senate Plenary approved the Bill that expands the number of beneficiaries entitled to emergency aid of BRL 600 (six hundred reais) paid to low-income workers affected by the pandemic. The bill that replaces the so-called “coronavoucher” extends the benefit to other categories of informal and self-employed workers, as well as ensuring that the benefit only covers workers with regularised Individual Taxpayer’s Registry. The Bill awaits presidential approval. Bill no. 873/2020.

CASTING VOTE IN THE BRAZILIAN TAX APPEALS BOARD (“CARF”): The National Institute of Defence in Administrative Procedure (Indepead) initiated a Public Civil Action with the purpose of extinguishing article 28 of Law 13,988 of 14 April 2020, which determines the end of the casting vote in the Brazilian Tax Appeals Board (CARF). Under the argument of affront to the Federal Constitution and the National Tax Code, the Institute alleges usurpation of jurisdiction and that the current economic scenario cannot afford the tax effects of such measure. CREDIT LINE FOR MICRO AND SMALL-SIZED COMPANIES:  The House of Representatives approved the Senate Bill which provides a special credit line for micro and small businesses to borrow amounts corresponding to up to 30% of their gross revenues obtained in 2019. The payment term will be 36 months with an eight-month grace period to begin paying the instalments. During the grace period, the loan will be adjusted only by the current Selic rate. The approved proposal will be returned to the Senate due to the changes. Bill No. 1282/2020.

SUSPENSION OF TAXES’ PAYMENT: the Court of Appeals of São Paulo granted an injunction to a company to suspend for 60 days the payment of Urban Property and Territorial Tax (IPTU) and Tax over Services (ISS). In the process, the plaintiff’s request was denied in the first instance. After the filing of a Bill of Review, the injunction was granted by the Court. Bill of Review No. 2067266-72.2020.8.26.0000.

COVID-19 COMBATING MEASURES IN THE BRAZILIAN FEDERAL DISTRICT (BRASILIA REGION): The House of Representatives of the Federal District approved Bill No. 1,136/2020 which requires the use and supply of protective masks in public, industrial, commercial, banking, road, subway and passenger transport establishments as a measure to combat the spread of the new coronavirus. The act shall now be approved by Governor Ibaneis Rocha. Bill No. 1,136/2020.

INCIDENCE OF ISOLATED FINE IN THE TAX COMPENSATION: Judge Gilmar Mendes of the Brazilian Supreme Court (STF) requested time to examine the case that discusses the application of the 50% fine on the amounts of tax refund or compensation deemed undue by the Federal Revenue Office (“isolated fine”). In the same vein, the Direct Unconstitutionality Action No. 4905 which deals with the matter has been removed from the agenda of the virtual plenary session. Special Appeal No. 796939/RS.
