RECEITA ZERA ALÍQUOTAS DE PRODUTOS DE COMBATE AO COVID-19: A Portaria nº 158, de 15/04/20, publicada nesta quinta-feira (16/04/20), estabelece requisitos e condições para a aplicação do Regime de Tributação Simplificada. A medida está prevista para que os produtos destinados ao combate à Pandemia que sejam importados por meio de remessas postais ou encomendas aéreas internacionais no valor de até 10 U$ mil terão suas alíquotas do imposto de importação zeradas e serão isentas do IPI e do PIS/Cofins. COMITÊ DE CRISE DA COVID-19: Conforme a Resolução nº 3, de 15/05/20, publicada nesta quinta-feira (16/04/2020), foi instituído Grupo de Trabalho para coordenação de ações de construção de hospitais de Campanha Federal, bem como a Logística Internacional de Equipamentos Médicos e Insumos de Saúde. Os artigos 2º e 3º desta Resolução objetivam suas competências, e ainda, sua composição. Resolução nº 3, de 15/04/20.

PROIBIÇÃO DE COBRANÇAS DE TARIFAS EM TRANSFERÊNCIA ELETRÔNICA: O Projeto de Lei nº 1.820/20, de 13/04/2020, visa a proibição da cobrança de tarifas durante calamidades e emergências públicas. Neste sentido, caso haja a aprovação do Projeto, as transferências eletrônicas por meio de Transferência Eletrônica Disponível (TED) e Documento de Ordem de Crédito (DOC) não serão tarifadas durante a pandemia. COMISSÃO DE ACOMPANHAMENTO AS MEDIDAS EMERGÊNCIAIS: Na próxima segunda-feira (20/04/2020), será instalada uma Comissão Virtual que acompanhará a execução de medidas referentes à Pandemia. A comissão será composta por 6 deputados, 6 senadores e 12 suplentes e, mensalmente, realizará reuniões com o Ministério da Econômica para avaliação das situações fiscal, orçamentária e financeira decorrentes das medidas adotadas durante a Pandemia.

JUSTIÇA FEDERAL PROÍBE AUMENTO DE JUROS DE EMPRÉSTIMOS: Nesta quarta-feira (15/04/2020), a Justiça Federal do Distrito Federal (9ª Vara) deferiu liminar que proíbe o aumento de juros de empréstimos e a adoção de exigências para concessão dos créditos para o mercado nacional.

APROVAÇÃO DA PROPOSTA DE EMENDA CONSTITUCIONAL (PEC) DO “ORÇAMENTO DE GUERRA”: Foi aprovada (58×21) em 1º turno a chamada PEC do “Orçamento De Guerra”, para combate à pandemia do novo coronavírus. Na prática a finalidade da PEC é conter o impacto fiscal na economia. Aguarda-se aprovação em 2º turno.

SUPREMO TRIBUNAL FEDERAL NEGA ADIAMENTO DE JULGAMENTOS VIRTUAIS: Devido à quarentena, julgamentos tributários relevantes, que já estavam agendados, foram direcionados para o meio virtual. Esta prática tem desagradado advogados, e até o momento todos os pedidos de adiamento de julgamentos foram negados.

SUPREMO TRIBUNAL FEDERAL DECIDE QUE ESTADOS E MUNICÍPIOS PODEM ESTABELECER NORMAS SOBRE ISOLAMENTO SOCIAL: O STF (ADI 6341) decidiu, na data de ontem (15/4/20), que os Estados e Municípios têm competência comum (art. 23, II) com a União Federal para dispor sobre as atividades essenciais, inclusive para fins de enfrentamento da Pandemia. Neste sentido, caberá também aos Governadores e aos Prefeitos decisões sobre tais como sobre a continuidade e interrupção de atividades (classificação como essenciais).

ZERO QUOTAS OF PRODUCTS TO COMBAT COVID-19: Ordinance No. 158 of 15/04/20, published this Thursday (04/16/20), establishes requirements and conditions for the application of the Simplified Taxation System. The measure is intended for products intended to combat Pandemic that are imported by means of postal consignments or international air parcels in the amount of up to 10 U$ thousand will have their import tax rates zeroed and will be exempt from IPI and PIS/Cofins. COVID-19 CRISIS COMMITTEE: According to Resolution No. 3 of 15/05/20, published this Thursday (04/16/2020), a Working Group was established to coordinate actions for the building of Federal Campaign hospitals, as well as the International Logistics of Medical Equipment and Health Inputs. PROHIBITION OF FEES ON WIRE TRANSFERS: Bill no. 1,820/20 of 13 April 2020 aims at prohibiting the collection of bank fees during calamities and public emergencies. In this sense, if the Bill is approved, electronic transfers through Available Electronic Transfer (TED) and Credit Order Document (DOC) will not be subject to fees during the pandemic. EMERGENCY MONITORING COMMISSION: Next Monday (20 April 2020), a Virtual Commission will be installed to monitor the implementation of measures concerning the Pandemic. The committee will be composed of 6 deputies, 6 senators and 12 alternates and will hold monthly meetings with the Ministry of Economic Affairs to assess the tax, budgetary and financial situations arising from the measures adopted during the Pandemic.

FEDERAL JUSTICE PROHIBITS INCREASE IN INTEREST ON LOANS: This Wednesday (15 April 2020), the Federal Court of the Federal District (9th Court) granted a preliminary injunction that prohibits both the increase in interest on loans and the adoption of requirements for granting loans for the Brazilian national market.

APPROVAL OF THE CONSTITUTIONAL AMENDMENT PROPOSAL (PEC) OF THE “WAR BUDGET”: The so-called “War Budget” PEC was approved (58×21) in the first round to combat the new coronavirus pandemic. In practice, the purpose of the PEC is to contain the tax impact on the economy. Pending approval in 2nd round.

SUPREME FEDERAL COURT DENIES THE POSTPONEMENT OF VIRTUAL JUDGMENTS: Due to the quarantine, relevant tax judgments which were already scheduled were directed to the virtual environment. This practice has displeased lawyers but so far all requests for adjournments have been denied.

SUPREME FEDERAL COURT (STF) DECIDES THAT STATES AND MUNICIPALITIES MAY DETERMINE RULES ON SOCIAL ISOLATION: The STF (ADI 6341) decided as of yesterday (15 April 2020) that States and Municipalities have common jurisdiction (art. 23, II ) with the Federal Government to decide on essential activities including for the purpose of facing Pandemic. In this sense, it will also be up to the Governors and the Mayors to make decisions such as on the continuity and interruption of activities (classification as essential).
