COMITÊ DE CRISE DA COVID-19: De acordo com a Resolução nº 2, de 14/04/20, publicada hoje (15/04/2020), foi alterado o art. 3º do Decreto nº 10.277, de modo que passe a compor o Comitê de Crise para Supervisão e Monitoramento dos Impactos da Covid-19): “XV – Gabinete de Segurança Institucional da Presidência da República; XVI – Advocacia-Geral da União; XVII – Ministério da Saúde; e XVIII – Secretaria Especial de Assuntos Estratégicos da Presidência da República”. Resolução nº 2, de 14/04/20.

CONTRA ADIAMENTO DA LGPD: O MPF divulgou, nesta terça-feira (14/04/2020), uma Nota Técnica em que defende que a Lei Geral de Proteção de Dados (LGPD) entre em vigor em agosto de 2020, adiando para 2021 apenas suas sanções. A Nota Técnica, enviada para o Congresso Nacional, refere-se ao Projeto de Lei nº 1.179/20.

CONTRATO VERDE E AMARELO: Nesta terça-feira (14/04/2020) foi aprovado pela Câmara dos Deputados a Medida Provisória 905/19 referente ao chamado “Contrato Verde E Amarelo”. O Programa foi criado com o intuito de redução dos encargos trabalhistas, e, consequentemente viabilizar a geração de empregos.

REGRAS DAS COMPANHIAS AÉREAS: Diante da grande quantidade de reclamações por parte de passageiros, o MPF requereu às empresas aéreas (Latam, Gol, Azul e Passaredo) que informem as regras de remarcação e reembolso aos clientes adotadas em razão da Pandemia. O prazo para prestação das informações é de 5 (cinco) dias, segundo o MP.

SUSPENSÃO DE PAGAMENTO DE CRÉDITOS EM RJ: A 8ª Vara Cível de São Bernardo do Campo/SP decidiu que em face dos efeitos econômicos da Pandemia, os valores devidos pela Autora devem ter sua exigibilidade suspensa até o dia 10/07/20. A decisão teve aprovação do administrador judicial, e, ainda, parecer favorável do MP. Processo nº 1024091-12.2014.8.26.0564.

FIM DO VOTO DE QUALIDADE: No dia de 14/04/20, foi publicada a Lei nº 13.988 (MPV 899) que, alterando o Decreto nº 70.235/72, extinguiu o chamado “Voto de Minerva” (ou voto de “desempate, exercido pelo presidente da sessão de julgamento) no Conselho Administrativo de Recursos Fiscais (CARF), estabelecendo que “em caso de empate no julgamento, não se aplica o voto de qualidade (…), resolvendo-se favoravelmente ao contribuinte”.

MPF COBRA EXPLICAÇÕES AO GOVERNO DE SP: O MPF enviou Ofício em que cobra explicações ao governo de São Paulo sobre um noticiado acordo realizado com as operadoras de telefonia celular, referente ao monitoramento de inteligência de São Paulo (SIMI -SP), com o intuito de evitar a contaminação simultânea pelo covid-19. COVID-19 CRISIS COMMITTEE: According to Resolution No. 2 of 14 April 2020, published today (15 April 2020), Article 3 of Decree No. 10277 was amended so that the Crisis Committee for Supervision and Monitoring of the Impacts of Covid-19) include the following: “XV – Office of Institutional Security of the Presidency of the Republic; XVI – Advocacy General of the Union; XVII – Ministry of Health; and XVIII – Special Secretariat for Strategic Affairs of the Presidency of the Republic”. AGAINST POSTPONEMENT OF DATA PROTECTION LAW (LGPD): On Tuesday (14 April 2020), the Federal Prosecutor’s Office (MPF) released a Technical Note advocating that the General Data Protection Law (LGPD) should come into force in August 2020 and that only its sanctions should be postponed to 2021. The Technical Note sent to the National Parliament refers to Bill no. 1,179/20.

GREEN AND YELLOW CONTRACT: This Tuesday (14 April 2020) the House of Representatives approved the Provisional Measure 905/19 regarding the so-called “Green and Yellow Contract”. The Program was created with the purpose of reducing labour charges and, consequently, making it possible to generate jobs.

RULES OF AIR COMPANIES: In view of the large number of complaints from passengers, the Federal Prosecutor’s Office (MPF) required airlines (Latam, Gol, Azul and Passaredo) to inform the rules of rescheduling and reimbursement to customers adopted due to the Pandemic. The deadline for providing the information is five (5) days, according to the MPF.

SUSPENSION OF CREDIT PAYMENT IN JUDICIAL RECOVERY: The 8th Civil Court of São Bernardo do Campo/SP decided that in view of the economic effects of the Pandemic, the values due by the Claimant should have their enforceability suspended until 10 July 2020. The decision was approved by the judicial trustee and the Prosecutor also issued a favourable opinion. Case No. 1024091-12.2014.8.26.0564.

END OF “QUALITY VOTE”: Law No. 13,988 (MPV 899) – published on 14 April 2020 – amended Decree No. 70,235/72 to abolish the so-called “Casting Vote” (or “tie-breaking” vote from by the president of the trial session) in the Administrative Tax Appeals Council (CARF) determining that “in case of a tie in the trial, the casting vote shall not apply (…), resolving in favour of the taxpayer”.

FEDERAL PROSECUTOR’S OFFICE REQUESTS EXPLANATIONS TO SÃO PAULO’S GOVERNMENT: The Federal Prosecutor’s Office (MPF) sent a letter in which it requests explanations to the government of São Paulo about a new agreement made with the cellular phone operators relating to the “Monitoring of Intelligence of São Paulo” (SIMI -SP) which aims at avoiding simultaneous contamination by covid-19.
