DIFERIMENTO DO PRAZO PARA RECOLHIMENTO DOS TRIBUTOS: com a afetação da economia pela crise do novo coronavírus, o TRF1 deferiu em sede de antecipação de tutela recursal, o diferimento do prazo para recolhimento dos tributos federais, vincendos e vencidos a partir de 31/03/2020, e das parcelas dos acordos de parcelamento celebrados com a União, bem como determinou que seja obstada a inclusão do nome das empresas em cadastro de devedores, e a negativa de renovação de sua certidão de regularidade fiscal em relação aos tributos e acordos de parcelamentos cujos prazos de vencimento foram postergados a partir da presente decisão. REGRAS DE FLEXIBILIZAÇÃO NAS RELAÇÕES JURÍDICAS PRIVADAS: o Senado aprovou o PL 1.179/2020, que trata da criação de regras transitórias para flexibilização das relações jurídicas privadas, atenuando as consequências socioeconômicas da Covid-19 e suspendendo temporariamente algumas exigências legais, de modo a preservar contratos e servir de base para futuras decisões judiciais. A proposta segue para votação na Câmara dos Deputados. Projeto de Lei nº 1.179/2020.

RECEITA FEDERAL PRORROGA PRAZOS PARA APRESENTAÇÃO DE DECLARAÇÕES: fica prorrogado em caráter excepcional o prazo para apresentação das (i) Declarações de Débitos e Créditos Tributários Federais (DCTF) para o 15º dia útil de julho; (ii) Escrituras Fiscais Digitais da Contribuição para o PIS/Pasep, da Contribuição para o Financiamento da Seguridade Social (Cofins) e EFD-Contribuições para o 10º dia útil de julho. PRORROGAÇÃO DO PRAZO DAS CONTRIBUIÇÕES: em decorrência da pandemia relacionada ao novo coronavírus, o Ministério da Economia prorrogou por 4 meses o prazo para o recolhimento de tributos federais, devendo (i) as contribuições previdenciárias devidas pelas empresas e pelo empregador doméstico, e (ii) o recolhimento a Contribuição para o PIS/PASEP e da Contribuição para o Financiamento da Seguridade Social – COFINS, serem pagas no prazo de vencimento das competências de julho e setembro de 2020. MEDIDAS DE ENFRENTAMENTO AO COVID-19: o Plenário da Câmara dos Deputados aprovou, a chamada PEC do “orçamento de guerra” (PEC 10/20), que permite a separação do orçamento e dos gastos realizados para o combate à pandemia de novo coronavírus do orçamento geral da União. As regras terão vigência durante o estado de calamidade pública, e os atos de gestão praticados desde 20/03/2020 serão convalidados. O objetivo da proposta é criar um regime extraordinário para facilitar a execução do orçamento relacionado às medidas emergenciais, afastando possíveis problemas jurídicos para os servidores que processam as decisões sobre a execução orçamentária. PRORROGAÇÃO DE PRAZO DAS CONTRIBUIÇÕES DO SIMPLES NACIONAL: o Comitê Gestor do Simples Nacional (CGSN), em razão dos impactos econômicos gerados pela pandemia do novo coronavírus, prorrogou para 30/06/2020 o prazo de pagamento de tributos que integram o regime diferenciado das Microempresas e Empresas de Pequeno Porte. CRIADO PROGRAMA DE FINANCIAMENTO DE FOLHAS DE PAGAMENTO: para enfrentar os efeitos econômicos da pandemia da Covid-19, o governo federal lançou o Programa Emergencial de Manutenção do Emprego e da Renda. Serão preservados até 8,5 milhões de empregos, beneficiando cerca de 24,5 milhões trabalhadores com carteira assinada. O principal objetivo da medida é reduzir os impactos sociais relacionados ao estado de calamidade pública e de emergência de saúde pública. Medida Provisória nº 944, de 03/04/2020.

 

POSTPONEMENT OF THE DEADLINE FOR PAYMENT OF TAXES: With the impact of the economic crisis due to the new coronavirus, the First Federal Regional Court granted the postponement of the deadline for payment of federal taxes, due and past due as of 31 March 2020 and of the instalments relating to instalment payment agreements entered into with the Federal Government, as well as determined that the inclusion of the name of the companies in the debtors’ registry and the refusal to renew their certificate of tax good standing in relation to the taxes and instalment agreements whose due dates have been postponed as of the present decision is hindered. RULES OF FLEXIBILISATION IN PRIVATE LEGAL RELATIONS: The Senate approved the Bill No. 1,179/2020, which addresses the creation of transitional rules to make private legal relations more flexible, mitigating the socioeconomic consequences of Covid-19 and temporarily suspending some legal requirements in order to preserve contracts and serve as a basis for future court decisions. FEDERAL REVENUE OFFICE EXTENDS DEADLINES FOR STATEMENTS:  the following deadlines are extended, on an exceptional basis: submission of (i) Federal Tax Debts and Credits’ Statements (DCTF) until the 15th working day of July ; (ii) Digital Tax Bills for the PIS/Pasep Contribution, the Social Security Financing Contribution (Cofins) and EFD-Contributions until the 10th working day of July. EXTENSION OF CONTRIBUITIONS’ DEADLINES: as a result of the pandemic related to the new coronavirus, the Ministry of Economy extended by 4 months the deadline for payment of federal taxes, pertaining to (i) the social security contributions owed by companies and by the domestic employer, and (ii) the payment of the PIS/PASEP contribution and the Social Security Financing Contribution – COFINS, to be paid by the July and September 2020 deadlines. COVID-19 COMBATING MEASURES: the plenary of the House of Representatives approved the so-called “war budget” (Proposed Constitutional Amendment, PEC 10/20) which allows a separation of the budget and expenditure for combating the new coronavirus pandemic from the general budget of the Federal Government.  The rules will be valid during the state of public calamity, and the management acts practiced since 20 March 2020 will be validated. The objective of the proposal is to create an extraordinary regime to facilitate the performance of the budget related to the emergency measures, ruling out possible legal problems for the servers that process the decisions on the budget execution. DEADLINE EXTENSION OF SIMPLES’ (TAX REGIME APPLICABLE TO SMALL COMPANIES) CONTRIBUTIONS: the Management Committee of the Small Companies’ Contributions (CGSN), due to the economic impacts due to the pandemic of the new coronavirus, extended to 30 June 2020 the deadline for the payment of taxes that integrate the differentiated regime of Micro and Small Companies. FINANCING PROGRAMME RELATING TO PAYROLL IS CREATED: to confront the economic effects of the Covid-19 pandemic, the federal government launched the Emergency Program for the Maintenance of Employment and Income. Up to 8.5 million jobs will be preserved, benefiting about 24.5 million workers with signed labour records.  The main objective of the measure is to reduce the social impacts related to the state of public calamity and public health emergency.
